By booking a place in any professional training class ("the Class") organised by FoMa Dance Company Limited ("FoMa"), you ("the Participant") agree to be bound by the following Terms and Conditions.

1. Booking Confirmation

1.1 Your booking is confirmed once full payment has been received by FoMa.

1.2 A place in the Class is not reserved until payment is cleared.

1.3 FoMa reserves the right to refuse or cancel any booking at its sole discretion.

2. Payment and Refunds

2.1 All fees are payable in full at the time of booking.

2.2 No refunds will be provided once a booking is completed and payment has been received.

2.3 Participants may request to switch their booking to an alternative class by contacting FoMa at least 48 hours prior to the scheduled class, subject to availability. No refunds will be provided for missed sessions or cancellations.

2.4 In the event that FoMa cancels a Class, Participants will be offered a credit for a future class (valid for [3] months).

3. Liability and Waiver

3.1 Ballet and dance training involves physical exertion and inherent risk of injury. Participation is physically demanding and may result in injury, including but not limited to muscle strains, sprains, fractures, and in rare cases, more serious injury.

3.2 To the fullest extent permitted by law, FoMa Dance Company Limited excludes all liability for any injury, accident, loss, or damage sustained by the Participant during or in connection with the Class, including any liability arising from negligence, breach of statutory duty, or other act or omission on the part of FoMa, its employees, agents, representatives, or instructors.

3.3 The Participant acknowledges and accepts that participation in the Class is entirely at their own risk.

3.4 The Participant is solely responsible for ensuring that they are physically fit, medically cleared, and able to participate in the Class. Participants with pre-existing injuries, medical conditions, or any doubt about their fitness are strongly advised to seek medical advice before attending.

3.5 The Participant confirms that they have not been advised against physical activity by a medical professional and that they are not aware of any condition that would make participation unsafe.

3.6 The Participant waives any and all claims against FoMa Dance Company Limited, its directors, employees, agents, and instructors arising from or in connection with their participation in the Class.

4. Studio Damage

4.1 The Participant shall be liable for any damage caused to the studio, equipment, or property during the Class that is caused by the Participant's negligence, recklessness, or wilful misconduct.

4.2 FoMa reserves the right to invoice the Participant for the cost of repair or replacement of any such damage.

5. Amendments and Cancellations by FoMa

5.1 FoMa Dance Company Limited reserves the right to:

(a) Modify the Class schedule, time, or venue;

(b) Amend the Class content, structure, or duration;

(c) Cancel the Class; or

(d) Substitute the teacher or accompanist, in its sole discretion and without prior notice.

6. Conduct and Safety

6.1 Participants must treat all staff, teachers, and fellow participants with respect at all times.

6.2 Participants must follow all instructions given by the teacher and studio staff.

6.3 Disruptive, unsafe, or inappropriate behaviour will not be tolerated.

6.4 FoMa reserves the right to remove any Participant from the Class if their behaviour is in breach of this Code of Conduct. No refund or credit will be provided in such circumstances.

7. Photography and Recording

7.1 Participants must not take photographs or videos during the Class without prior written permission from FoMa.

7.2 FoMa may take photographs or videos for promotional purposes.

8. Personal Belongings

8.1 Participants are responsible for their own personal belongings at all times.

8.2 FoMa accepts no liability for any loss, theft, or damage to personal property.

9. Governing Law

These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region.

10. Acceptance of Terms

By booking and attending a Class, the Participant acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
